Copyright is a legal right that grants the creator of original work exclusive rights to its use and distribution. In India, it's governed by the Copyright Act, 1957, amended in 2022. Copyright protection is automatic upon creation - no registration is required, but registration provides legal evidence.
Automatic Protection in India
Unlike patents or trademarks, copyright protection begins the moment your work is created and fixed in a tangible form. This means your song, book, painting, or software code is protected immediately under Indian law (Section 13 of Copyright Act). Registration at Copyright Office is optional but recommended for legal disputes.
What Rights Does Copyright Provide?
Copyright gives you exclusive rights to: 1) Reproduce the work, 2) Distribute copies, 3) Perform publicly, 4) Display publicly, 5) Create derivative works, and 6) In some cases, moral rights (paternity and integrity). These rights typically last for the author's lifetime plus 60 years after death in India.
